ABOUT THE COMPETITION

a) This Competition is based on photography skill and creativity. It is not determined by chance. No product or service purchase is necessary to enter or win the Competition.

b) By entering into the Competition, the participant agrees to the terms and conditions herein (“Terms and Conditions”) and accepts the decisions of Lanson Place Causeway Bay (“LPHK”) as final and binding on all matters or disputes related to the Competition including but not limited to the participant’s eligibility, the selection of winners and disqualification of the participant. No appeal or any correspondence will be entertained.

ELIGIBILITY

a) The participant must be aged 18 or above or be permitted by his/her parent or legal guardian to participate in the Competition.

b) Should the participant fail to satisfy the eligibility criteria, LPHK shall at its sole and absolute discretion disqualify such participant and forthwith discard his/her entry as ineligible and invalid without notice or liability to such participant. This is so in spite of the participant being selected as a winner.

HOW TO ENTER THE COMPETITION

a) Participants must, from 9 December 2024 until 2 January 2025 both days inclusive (“Competition Period”), log in to their public profile on Instagram or Little Red Book and complete the following steps:

• Follow @LansonPlaceCausewaybay on Instagram or 逸兰酒店及服务式公寓 on Little Red Book.
• Like the official competition post on Instagram or Little Red Book.
• Post a photo or video of the ribbon installation at Lanson Place Causeway Bay on Instagram (as story or feed post) or Little Red Book.
• Tag @LansonPlaceCausewaybay in the post and include #MyPlaceLansonPlace .

All dates and times stipulated above are based on Facebook server Hong Kong time (GMT+8). All non-conforming entries will not be accepted.

b) Each participant shall participate in the Competition once only. Only the first submission will be accepted in case of multiple entries being made by the same participant.

c) LPHK shall not be responsible for: (i) Lost, delayed or misdirected entries, omission, falsity, unrecognizability or damage to the submitted information; (ii) Any inaccurate or incomplete information provided by the participant; or (iii) Any problems or technical malfunction of telephone, computer or Internet network, services, servers, systems and/or technology that may cause delay, interruption or failure in the operation or transmission of all or part of the participant’s information, or the notification to or announcement of the selected winner.

PERSONAL DATA AND INTELLECTUAL PROPERTY RIGHTS

a) By entering into this Competition, the participant is deemed to have consented to, and has procured the consent of the persons featured in the post, LPHK, to collect, use, edit, alter, copy, exhibit, display, publish, distribute or reproduce his/her personal data (“Personal Information”) including but not limited to his/her name in any form of media or publications for the purpose of the Competition (including but not limited to posting, printing, uploading, displaying on the Internet, Facebook, Instagram, the ship and any other media or marketing channels), and LPHK’s announcement of selected winners, and marketing and research activities, and receive promotional messages, without requiring any further notification or approval by the participant and the persons featured in the post comment, and without requiring to pay any payment, royalties, compensation or any other consideration in perpetuity. LPHK reserves the right of final interpretation and final decision with respect to all of the marketing arrangements, and winners may not object to it.

If the consent stated in the above paragraph is subsequently disputed or withdrawn by the participant or any or all persons featured in the photo, the participant may be disqualified and his/her entry discarded as ineligible and invalid.

The Personal Information collected will be destroyed twelve (12) months after the Competition Period ends.

The participant or any or all persons featured in the post comment have the right to obtain a copy of, check and review, supplement or revise, delete, and stop or opt out from the collection, process or use of the Personal Information provided to LPHK. Any such requests and any other inquiries or complaints in respect to the Personal Information should be made in writing to: Email Address: dc.digitalmarketing@gentingcruiselines.com

Take note however that if any participant or any person featured in the post comment supplement, revise, delete or stop or opt out from the collection, process or use of their Personal Information provided to LPHK, the participant may be disqualified and his/her entry discarded as ineligible and invalid.

b) The participant agrees that all intellectual property rights subsisting in or in connection with the materials including the post comment submitted for the Competition shall belong entirely to LPHK without payment, royalties, compensation or any other consideration in perpetuity. The participant grants, and has procured the consent of the creator of the post comment to grant, LPHK, an irrevocable, worldwide, transferable, royalty-free, exclusive, sub-licensable license to use, edit, alter, copy, exhibit, display, publish, distribute, reproduce, create derivative works from and/or incorporate in other works the post comment in any form, media or publications, and in such manner for such purposes as deemed appropriate by LPHK without any further notice to the participant or the creator, and expressly disclaim any right over the content.

WARRANTY INDEMNIFICATION

a) The participant warrants that:

(i) all materials including the photo or video post, distributed, reproduced or submitted to the Competition shall be his/her original creation, and will not infringe any third party’s intellectual property rights or proprietary information and there is no other license or consent required but not yet obtained for the use or publication of the materials;

(ii) the post will not contain any content that is defamatory, untrue, offensive, illegal, obscene, pornographic, or incites violence or harm, or is inappropriate or adverse to LPHK’s reputation, or is in breach of any party’s privacy rights or terms of other agreements; and

(iii) all information provided to LPHK shall be reliable, accurate and complete.

b) LPHK assumes no liability to check that all information including the post comment complies with the Terms and Conditions. Should LPHK at its sole and absolute discretion determine that the participant and/or the post comment does not comply with the Terms and Conditions, LPHKs reserves the right to disqualify the participant or cause the post comment to be removed or edited without liability or compensation.

c) Without prejudice to LPHK’s any rights and remedies, the participant shall release, discharge, defend indemnify and hold LPHK harmless in full from and against all claims, liabilities, proceedings, losses, damages, costs and expenses (including but not limited to legal expenses) awarded against, incurred or paid by LPHK arising from or in connection with, whether directly or indirectly, the post comment or information used or published by the participant, or any act, omission or the breach or non-compliance with any of the Terms and Conditions, obligation or warranty given by the participant, and/or any claim that the post comment or information used or published by the participant infringes the intellectual property rights or any rights of third parties. This indemnification shall survive despite the end of the Competition Period.

WINNERS

a) All eligible entries received during the Competition Period and conforming to all the Terms and Conditions shall, after the end of the Competition Period, be considered by a panel of judges who will select the top five posts as winners. LPHK reserves the right to change the winner’s selection method at its sole discretion.

b) All winners will be contacted via direct message on Instagram or Little Red Book by 17 January 2024. LPHK shall not be responsible or liable for any delays in the result announcement.

c) The winners must respond to the direct message within seven (7) calendar days after 17 January 2024. LPHK will inform the winners about the prize redemption details. Should the winners fail to reply within seven (7) calendar days, or should LPHK unable to contact the winner or verify the identity of the winner, either due to any unforeseeable factors, inaccurate information or inadequate information provided, the winner’s entitlement to the prize will be forfeited and replaced by another winner. LPHK will not give separate notice on such forfeiture and replacement as stated above.

PRIZES

a) Five winners will each win a complimentary one-night room stay with club privileges for two persons in LPHK. LPHK reserves the right to offer prize substitutions without consultation or notice to the participant at any time. The complimentary room stay is subject to availability and black-out dates apply.

b) The winner of the Competition must agree to and abide by the terms and conditions given by the prize provider(s). LPHK reserves the right to change all or any part of the terms and conditions.

c) To the maximum extent permitted by the law, LPHK and third party services shall not be responsible for any risk, consequence, loss, damage (including but not limited to indirect or consequential loss) or death or personal injury which is suffered or sustained by the participant or any other party arising from or in connection with the Competition, the prize or prize redemption.

d) The prizes are awarded in their “as is” condition and shall not be transferable or exchangeable for cash, credit, goods or services. LPHK does not represent, warrant or guarantee the quality, fitness for purpose or availability of the prizes, and shall bear no responsibility or liability whatsoever with regard to any matter arising from or in connection with the prizes.

e) The winner shall be solely and fully responsible for the exclusions listed below, and all taxes, fees, surcharges or liabilities arising from or in connection with the Competition and the prizes that he or she has won. Likewise, winners shall be responsible in ensuring that they have valid passports and other travel documents at the time of and for the whole length of the travel.

GENERAL MATTERS

a) The Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Hong Kong Court shall have non-exclusive jurisdiction in the event of any disputes, claims or proceedings arising from or in connection with the Competition and the Terms and Conditions.

b) No person other than the participant and LPHK will have any right to enforce the Terms and Conditions.

c) The Terms and Conditions shall apply and supersede any other marketing materials or communications.

d) LPHK reserves the right to amend, modify, suspend, postpone or terminate any part of the Competition, the Competition Period and/or amend the Terms and Conditions at any time without prior notice or reason.

e) LPHK reserves the right of final interpretation with respect to the Terms and Conditions. In case of a dispute arising out of the Competition, LPHK reserves the right of final decision.

f) The Competition is not endorsed or sponsored by Facebook and Instagram. The participant shall be solely responsible for complying with the rules and policies of Facebook and Instagram.

g) The invalidity, illegality or unenforceability of any provision in these Terms and Conditions shall not affect the other provisions of these Terms and Conditions, which shall remain in full force and effect.
